By using the Capci platform, website, APIs, and related services (the "Service"), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service is operated by Techtrapture Private Limited ("Company", "we", "us"). "You" means the individual or organization using the Service.
Capci is an AI-powered platform that turns your ideas into branded content, generating social posts, images, and other visual formats styled with your own brand assets. Features include AI content generation, brand presets, a content library, multi-format generation, and download and export tools.
You must be at least 18 years old to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to act on its behalf.
You create an account using Google sign-in. You are responsible for keeping your account secure and for all activity that occurs under it.
You must not: abuse, circumvent, or attempt to evade usage limits or free-plan controls; reverse-engineer or interfere with the Service or its infrastructure; conduct adversarial or security attacks; upload brand assets or other content you do not have the rights to use; generate content that is unlawful, defamatory, hateful, sexually explicit involving minors, deceptive, or that infringes third-party rights; or use the Service to develop a competing product.
You are solely responsible for the content you generate and how you use it, including ensuring you hold the necessary rights to any logos, images, fonts, or other assets you upload. We may suspend or terminate accounts that violate these Terms, pose a security risk, or engage in activity that could harm other users or the integrity of the platform.
Capci offers a free plan with usage limits and one or more paid subscription plans with higher limits and additional features. Free-plan usage is subject to fair-use limits which we may adjust to keep the Service sustainable. Paid subscriptions are billed in advance on a recurring basis and auto-renew unless cancelled. Cancellation takes effect at the end of the current billing period.
Payments are processed by Razorpay, subject to their terms. Failure to maintain an active subscription restricts access to paid features. Prices may change, and we will give reasonable notice of any change to your recurring fee before it takes effect.
Subscription fees are non-refundable except where required by applicable law. Disputes regarding billing must be raised within 60 days of the charge. Contact legal@techtrapture.com for billing questions.
Your content: You own the ideas, prompts, brand assets, and content you submit, and (to the extent permitted by applicable law and the terms of the underlying AI providers) the content you generate with the Service. We only process it to provide the Service. We do not use your content to train our own models.
AI-generated output: Generated content is produced by third-party AI models and may be subject to those providers' usage terms. AI output may be unpredictable, may resemble other works, and may not be eligible for copyright protection in some jurisdictions. You are responsible for reviewing generated content before publishing or relying on it.
Our IP: The Service itself (code, design, generation engine, architecture, and the Capci branding) belongs to Techtrapture Private Limited. These Terms do not transfer any ownership to you.
Your use of the Service is governed by our Privacy Policy. You are responsible for ensuring that content you submit and generate complies with applicable laws in your jurisdiction.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY.
We do not guarantee the Service will be uninterrupted or error-free. AI models may produce inaccurate, biased, or inappropriate output; you are responsible for reviewing generated content before acting on or publishing it. The Service may be temporarily unavailable for maintenance or due to factors beyond our control.
To the maximum extent permitted by applicable law, Techtrapture Private Limited shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data, revenue, or business opportunity. Our aggregate liability for any claim arising out of or relating to the Service shall not exceed the fees paid or payable by you in the 3 months immediately preceding the claim, or ₹10,000 (Indian Rupees Ten Thousand), whichever is greater.
We may suspend or terminate your access if you violate these Terms, your subscription lapses, or if required by law. We may discontinue the Service with 60 days' written notice to your registered account email.
You may request account deletion anytime by emailing team@capci.app.
On termination, your access stops immediately. We will initiate permanent deletion of all associated data within 30 days, including backups. We do not retain your content after deletion. Billing records are retained as required by applicable law. Sections 5 (IP), 6 (Disclaimers), 8 (Governing Law), and 9 (Force Majeure) survive termination.
These Terms are governed by the laws of India, without regard to conflict of law principles.
In the event of any dispute, the parties shall first attempt resolution through good-faith negotiation. If unresolved, the dispute shall be referred to arbitration with a sole arbitrator appointed by mutual agreement. The seat of arbitration shall be Pune, Maharashtra, India, and proceedings shall be conducted in English.
Nothing in this clause prevents either party from seeking urgent interim or injunctive relief from a court of competent jurisdiction. Subject to the above, the courts of Pune, Maharashtra, India shall have exclusive jurisdiction.
Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including acts of God, natural disasters, pandemic, war, civil unrest, government action, internet or power outages, or failure of third-party infrastructure providers (including cloud and AI service providers). The affected party shall notify the other as soon as practicable and use reasonable efforts to resume performance.
We may update these Terms at any time. Material changes will be communicated within the Service or by email at least 15 days before they take effect. Continued use after changes constitutes acceptance.
